2 dead in Pike Creek crash

PIKE CREEK, Del. - July 15, 2008 It happened just before 7:30 at the intersection of Route 7 and Arundel Drive in Pike Creek.

A 2003 Toyota Camry, driven by 80-year-old Marian Fragetti of Wilmington, was traveling northbound on Route 7 in the left turning lane at Arundel Drive. Fragetti was attempting to turn into the Dougherty Funeral Home, located on the corner.

A 2000 Chevrolet Malibu, operated by David B. Deloya, 17, of Wilmington, was traveling southbound on Route 7 in the right lane when Fragetti made a left turn into the path of the Chevrolet. The Chevy struck the passenger side of the Toyota.

The front seat passenger in the Toyota, Benedict G. Halko, 79, of Newark, was killed by the impact, and was pronounced dead at the scene. He was not wearing his seat-belt.

Marian L. Fragetti was transported from the scene to Christiana Hospital where she was later pronounced dead.

Deloya was treated and released from Christiana Hospital with non-life threatening injuries.

Police say sun-glare is considered a factor in the crash on the part of Ms. Fragetti. Investigators have also determined that David Deloya had the right of way.

Investigators learned that Deloya was not a licensed driver and that he could not provide insurance documentation for his vehicle. He was cited for Driving Without a License and No Proof of Insurance.
