3 sentenced in Delaware fatal shooting

WILMINGTON, Del. (AP) - August 14, 2008 Marvin Davis pleaded guilty this year to manslaughter and a weapon charge in the June 2007 shooting that killed 18-year-old Michael Flakes as he played basketball near the scene of a street brawl. Davis was sentenced Wednesday to 13 years in prison. He apologized in court, saying the shooting shouldn't have happened.

Nineteen-year-old James Cooper was sentenced to 18 months in prison for aggressive menacing and reckless endangering. Nineteen-year-old Severa Davis was given a three-year prison term for conspiracy, criminal solicitation and a weapon charge.

A defense attorney says none of the men fired the fatal shot, but were charged as accomplices.
