Judge Carol McGinley says the steel and porcelain unit, called a "bubble," must come down because it was placed on Craig Bowes' property without permits.
Local zoning officials say Bowes placed the 11-by-14-foot structure on his property in December 2006 and has ignored an order to get rid of it.
Bowes says removing it could mean "a death sentence" for his wife, Elizabeth Feudale.
Feudale says she has an illness called multiple chemical sensitivity and needs a chemical-free environment.
The judge says she sympathizes with Feudale's medical problems, but there's no excuse for defying local regulations.
