Eagle Scout who started fatal fire avoiding jail

TOMS RIVER, N.J. (AP) - March 18, 2009 Eighteen-year-old Brian Lenz is to enter New Jersey's pretrial intervention program. He won't have a criminal record if meets the program's conditions for a year.

Authorities say Lenz used rubbing alcohol to try to re-ignite a fire last July at the Joseph A. Citta Scout Reservation in Ocean County. Flames shot back into the bottle and authorities say Lenz shook his arms. spraying flames onto the three teenage scouts.

Seventeen-year-old Sean Whitley of Evesham later died from the injury.

Lenz is charged with aggravated assault. He's expected to plead guilty and enter the program Thursday.
