David Martz was videotaped receiving oral sex from a woman, while he flew over San Diego.
The National Transportation Safety Board has ruled the action was so reckless, the pilot's license must be revoked.
The NTSB notes the woman had unfastened their safety belts and her body blocked access to the helicopter's controls.
The video showed on the Internet.
During a hearing, Martz admitted he acted foolishly in the 2005 incident but says he's become a much more responsible pilot since then.
Martz can apply in a year to have his license reinstated.
