CAMDEN, N.J. - May 15, 2009 - Lance Bean has been serving a 45-year sentence after he was
convicted of killing Donald Sanders in 2003. But a state appeals
court on Friday overturned the verdict because a juror was removed
during deliberations.
The juror had questioned some of the prosecution's witnesses and
lied to other jurors that he had visited the crime scene.
The appeals court wrote that the trial judge should have
declared a mistrial rather than substitute an alternate and
continue deliberations.
