Silveri was arrested in July 2008. Prosecutors say he used a state-issued laptop to set up meetings with an undercover officer posing as a woman willing to offer up her two young daughters for sex. But Silveri never showed up.
Defense attorney Steve Pacillio says Silveri never intended to follow through on the meetings.
Silveri resigned last year following his arrest.
