GRETNA, La. - August 6, 2009
A key prosecution witness told jurors Wednesday he was positive that Miller shot a 16-year-old fan during a 2002 nightclub melee in the New Orleans area. But witness Darneil Jordan Sr. admitted on cross examination that he never saw the rapper with a gun.
The case continues Thursday after a day of emotional testimony and graphic autopsy pictures.
If found guilty of second-degree murder, the 38-year-old Miller will spend the rest of his life in prison.
Miller was convicted in 2003. But the judge granted a new trial after finding prosecutors improperly kept the defense from seeing criminal background information on three witnesses.
