Carly Simon sues Starbucks over album

DATELINE Simon says in her lawsuit the album was not available in a substantial number of Starbucks stores during the first months of its release. She says later the CD was stocked at a reduced price, which she says stigmatized it.

Starbucks says in a statement it met its contractual obligations and even extended the amount of time it promoted the album in New York and Boston. The New York Times says the album sold only 124,000 copies. Simon will release a new album, "Never Been Gone," later this month.
