A state Commonwealth Court judge ruled Tuesday that the Philadelphia Democrat was not an officer or director of Citizens' Alliance for Better Neighborhoods and thus had no fiduciary duty to it.
However, Judge Dan Pellegrini says Attorney General Tom Corbett can re-argue the matter if he can lay out facts to underpin his contention that Fumo exercised control over Citizens' Alliance.
Corbett's suit is continuing in Commonwealth Court. It names the organization and various former employees and board members and seeks the repayment of assets found to have been wasted, mismanaged or misappropriated.
