Forty-five-year-old Richard Alten is scheduled to appear Monday in Philadelphia Municipal Court for a preliminary hearing. He's charged with stealing a watch from 63-year-old Joaquin Rivera as the older man sat unresponsive in an emergency room waiting area in November.
Officials say Rivera died of a heart attack. He sat motionless in a chair for nearly an hour before hospital staff checked on him.
Two other suspects have already pleaded guilty and been sentenced to probation.
