Criticism from Justice Stevens

He says that pressing Supreme Court nominees for their views is improper.

Stevens says it's unfortunate that senators try to pin down judicial nominees on issues during confirmation hearings.

He said that commenting about cases already decided is one thing for a nominee, but speculating about issues that could come before the court is entirely different.

Stevens says that a judge often doesn't know how he'll rule until the case has been argued.

Stevens was nominated less than three years after the landmark 1973 Roe v. Wade abortion decision.

But he wasn't asked a single question about abortion during his confirmation.
