Defense: 2 did not intend to kill Sgt. Liczbinski

PHILADELPHIA - July 23, 2010

The defense is wrapping up after more than four hours of arguments. Prosecutors are set to begin their closing later Friday.

Thirty-five-year-old Eric Floyd and 41-year-old Levon Warner could face the death penalty if convicted of first-degree murder in the May 3, 2008, death of Sgt. Stephen Liczbinski.

Authorities say Floyd and Warner were in the getaway vehicle when suspect Howard Cain got out and shot the pursuing Liczbinski. Cain died in a shootout with police.

Attorneys for Floyd and Warner say the whole robbery plot was Cain's and that their clients did not share in the intent to kill the sergeant.
