The accident happened around 9:50 p.m. on U.S. Route 13 Northbound at Lisa Drive.
Police say a Chevy Suburban, driven by Hezekiah T. Harmon IV, of Wilmington, swerved to avoid rear-ending a motorcycle.
Harmon now faces second-degree vehicular homicide, first-degree vehicular assault and driving under the influence charges.
Harmon's SUV went into the grass median and rolled several times.
A man travelling in the second row of the Suburban, Andre Massado, 29, of Wilmington, was killed in the crash. Police say Massado was not wearing a seatbelt.
Of the five injured, the most seriously hurt was John Trotter, 35, of Wilmington, was rushed to the hospital with severe head trauma.
Police say an investigation into this crash continues, and that alcohol is not considered a factor.
