Penalty phase resumes in Del. police killing trial

GEORGETOWN, Del. - February 15, 2011

Derrick Powell of Cumberland, Md., was convicted last week in the shooting death of Chad Spicer.

Prosecutors called their last witnesses Tuesday in the penalty phase. One said Powell threatened him with a gun in 2009 to get him to cash forged checks. The second, who lived briefly with Powell, said Powell pulled a knife on him after he told Powell to clean up a dirty plate.

Prosecutors told the Sussex County jury on Monday that Powell deserves the death penalty because he killed Spicer while fleeing an attempted robbery. The defense says he's the product of a dysfunctional family.
