Court orders exam of NJ's alcohol test

FREEHOLD, N.J. - April 6, 2011

The court ruled in the case of two Monmouth County men who challenged the reliability of a temperature probe used to calibrate the Alcotest device.

The state Supreme Court found the Alcotest to be scientifically reliable in 2008. However, the probe used on the device for that ruling is now made by a different manufacturer.

A Monmouth County judge will have 60 days to hold a hearing on the issue.

The Daily Record of Parsippany reports there were 36,064 DWI tickets issued in New Jersey between July 2009 and June 2010.
