Police: Charges in order in Upper Darby CO deaths

UPPER DARBY, Pa. - May 2, 2011

Upper Darby Police Superintendent Michael Chitwood says the men lived above a grocery store that used a generator to power its freezers after its electricity was shut off.

Chitwood says there was no intent to kill 57-year-old Ernesto Huerta and 50-year-old Stephen Butler, but the generator had a label warning of the dangers of carbon monoxide if it was used indoors.

The bodies of Huerta and Butler were found Friday after the generator ran for about 12 hours without ventilation.

The Delaware County District Attorney's office will ultimately decide if charges will be filed.
