Indictment tossed against NJ man who hit teen

MAYS LANDING, N.J. - July 28, 2011

The judge says prosecutors failed to give a complete picture of what happened in Egg Harbor Township on Sept. 6.

William Simkins' lawyer says the 31-year-old was chasing three teens on bicycles when 16-year-old Jason Broschard swerved into the car's path. Broschard was thrown from the bike and died at the scene.

The judge ruled that information was crucial in determining whether Simkins acted recklessly, which is an element of vehicular homicide.

Simkins fled the scene and turned himself in two hours later.

Assistant Prosecutor Diane Ruberton told The Press of Atlantic City the case would likely be presented to another grand jury.
