The man accused of tossing hot coffee on a donut shop clerk waived his right to a preliminary hearing on Wednesday.

David Timbers, 52, was apparently caught on surveillance cameras tossing that coffee at a Fresh Donuts store in West Philadelphia earlier this month.

Timbers and the clerk were arguing about whether he had paid for his food.

The clerk suffered 2nd degree burns to her arm. Timbers eventually surrendered to police.

The case now heads to trial.

Timbers is charged with aggravated assault.
