Mother, alleged baby buyer plead guilty to falsifying certificate

WILMINGTON - June 7, 2012

Bridget Wismer of Brookside Park, Del. pleaded guilty but mentally ill and John Gavaghan of the Pennypack Park section of Philadelphia pleaded guilty in Superior Court today to falsifying a birth certificate for the purpose of illegally transferring custody of a child.

Police say Wismer tried to sell her newborn to the Philadelphia man for $15,000 back in September.

The falsifying charge stems from Gavaghan's name being entered on the birth certificate of Wismer's newborn son, although he was not the father.

The charge carries a possible sentence of up to 5 years in prison and a fine of up to $10,000.

Delaware Attorney General's Office spokesperson Jason Miller says the state believes the plea was appropriate based on a psychiatrist's evaluation and diagnosis of Wismer.

The two were originally arrested on charges of Conspiracy and Dealing in Children in October of last year.

In exchange for the plea, the state dropped those charges.

Gavaghan's attorney Peter Veith told Action News he and his client are satisfied with the plea to the one charge and said that his client would not have any comment.

Sentencing for both is scheduled for August 17th.

The child, meanwhile, is in the custody of the Delaware Department of Services for Children, Youth and their Families.
