At issue in Commonwealth Court on Wednesday was a July 2012 report from a University of Washington professor concluding that more than 1 million registered voters lacked the photo-identification the law requires from each voter.
Plaintiffs who sponsored the survey brought in another witness, David Marker, who testified the methodology used in the survey was up to professional standards. A lawyer for the state's legal team sought to chip away at Marker's credibility on cross examination and asked Judge Bernard McGinley to exclude Marker's testimony. McGinley refused.
The plaintiffs hope to overturn the March 2012 law. The court has blocked enforcement since before last year's presidential election.
