Miami police backtrack in Colin Kaepernick incident

MIAMI

The phones at the Miami Police Department are ringing off the hook Thursday. And, everyone wants to know more about what happened at the Viceroy Hotel in downtown Miami.

The incident involves 49ers quarterback Colin Kaepernick, Seattle Seahawks player Ricardo Lockette and 49ers wide receiver Quinton Patton. It happened on April 1.

The report states that the woman who filed the complaint went to visit Lockette at an apartment at the Viceroy Hotel. Kaepernick and Patton were already there. The report does not say that a crime was committed.

It says the woman mixed some drinks and gave the three players some shots of alcohol. She claims they then told her that in order to drink the shots she had to hit a bong which contained marijuana.

They continued watching a basketball game. But, the woman says she went to the bedroom because she felt light headed. Kaepernick followed her and they started kissing. The report says they did not have sex.

The alleged victim says she can't remember anything after that. And, she woke up in a hospital bed without knowing how she got there or who transported her.

"I'm aware of the situation and don't know enough to comment on it," said Coach Jim Harbaugh.

Harbaugh wouldn't talk about the report at a celebrity golf tournament in West Palm Beach, but the organization did release a statement Thursday saying, "The 49ers organization is aware of the recent media report regarding Colin Kaepernick and is in the process of gathering the pertinent facts."

Attorney Ivan Golde has represented athletes in the past and says these types of cases can be tough to prove. He hopes nothing happened, but says in the world of professional sports, nothing surprises him.

"You shouldn't be surprised with anything that happens regarding any of these ball players because we just don't know who they are," said Golde.

Even if there are no charges, Kaepernick could face suspension or fines based on player conduct.

By midday, fans were all over the story and were not afraid to give their opinion.

"It's not true, that lady is probably just going after his money," said one fan.

The woman who filed the report did so two days later. Miami police would not say if the three players have been questioned.
