12-year-old girl arrested for pinching boy's butt at school

LONGWOOD, Fla. -- A 12-year-old girl faces a charge of battery after she pinched a boy's butt at school, according to officials.

Breana Evans was read her Miranda Rights, put in the back of a patrol car, and booked into juvenile detention after deputies said she pinched a boy's butt at her school near Orlando, Florida.

"It is just a joke," Breana said. "I feel like it's just stupid, just a stupid charge that shouldn't have to happen."

Breana's father, Ray Evans, said he believes the charge of misdemeanor battery was an overreaction.

"Lord what has this world come to? Kids can't even be a kid," he said.

Breana claimed the act was a "game" students play often at school.

Deputies said the pinching happened earlier in March and at the time the boy told the school resource deputy he didn't want to press charges.

Breana was suspended, but then deputies said the boy's mother called and said she wanted to prosecute.

That's when Breana was officially charged.

"All I can say for you, lady, is you need some help I think. Too overprotective," Ray Evans said.

According to the Seminole County state attorney, if Breana completes a diversion program, including community service and passing drug tests, the charge will be dismissed and her record would be clean.
