A judge has agreed to delay the murder trial of a New Jersey father accused of killing his 3-year-old son.

CAMDEN, N.J. (WPVI) -- A judge has agreed to delay the murder trial of a New Jersey father accused of killing his 3-year-old son.

David Creato Jr.'s trial was scheduled to start Monday. But the judge agreed to reschedule it for Jan. 9 after Creato's attorney, Richard Fuschino Jr., sought more time to obtain a report from an expert witness, a forensic medical examiner.

"On the one hand when you have someone sitting in custody it's the last thing you want, but we don't want to be hasty and rush this to a bad result either," Fuschino said.

Creato has pleaded not guilty to murder and child endangerment charges. He remains jailed on $750,000 bail.

Camden County prosecutors have said Creato's son, Brendan, suffered "homicidal violence."

They say the 23-year-old Haddon Township man killed his son because the boy was impeding his relationship with a teenage girlfriend who allegedly resented Creato's dealings with the child's mother.

Through it all, D.J. Creato has maintained his innocence and his parents have stood by him.

"It's hard for him," said his father, David Creato Sr. "His world changed from normal life to total craziness overnight."

With the anniversary of the death coming up, family members say a Mass will be held on October 15th at Holy Savior Church in Westmont to remember Brendan.
