Ex-prosecutor back on trooper assault case

A lawyer for an off-duty state trooper implicated in a sex assault investigation will remain on the case, an appeals court ruled Friday.

The court decided defense lawyer Patti Prezioso can continue to represent one of seven troopers suspended since a woman reported being sexually assaulted by off-duty officers she met at a Trenton bar in December.

The panel decided that Prezioso, a former deputy attorney general, is not bound by rules barring former prosecutors from taking on some criminal defense cases within six months of leaving their government jobs.

Prezioso, who represents the trooper in whose home the alleged attack occurred, according to court papers, said she was relieved to be back on the case.

A statement from the Middlesex County Prosecutor's Office, which is investigating the allegations, said it would not appeal the ruling.

No charges have been filed in the case.
