Battle over nudity at the beach

SAN CLEMENTE, Calif. (AP) - August 21, 2008

A pro-nudist group has filed a lawsuit claiming the state can't unilaterally change a policy without first holding a public hearing.

An Orange County Superior Court judge this week sided with naturists and ordered the state to allow nudity at the beach while the case goes through legal channels.

State park officials announced earlier this year they would outlaw nudity as of September 2 because they wanted to deter sexual activity.

The nude beach is tucked behind 50-foot-tall, rocky cliffs at San Onofre State Beach near San Clemente.
