TOMS RIVER, N.J. (AP) - October 31, 2008 Police say the boy was wearing a dark costume when he was struck while trying to cross Kettle Creek Road Thursday night.

Police say the 55-year-old driver has not been charged.

Children in the Ocean County community go trick-or-treating the day before Halloween because the town has a parade during the holiday.
