Police killer not in court for death-penalty phase

PHILADELPHIA - August 2, 2010

Eric Floyd tells the presiding judge he does not want to be present. Floyd has watched the trial through a remote TV hookup at the courthouse since punching his lawyer during jury selection.

The penalty phase comes after a jury last week convicted the 35-year-old Floyd and 41-year-old Levon Warner of murdering Sgt. Stephen Liczbinski after a May 2008 bank robbery. A third man who pulled the trigger died in a shootout with police.

The judge says Warner will be handcuffed in court for the penalty phase of the trial.
