Ex-police chief admits assaulting youth

PATERSON, N.J. - August 17, 2010

Former Prospect Park chief Frank Franco faces probation and a fine when he's sentenced for fourth-degree obstructing administration of law or other governmental function on Oct. 15.

Under terms of the plea deal, the 52-year-old, who retired in April, does not have to forfeit his pension. However, the state Pension Board can review the matter.

Franco said he went to police headquarters after the 16-year-old was arrested for the second time in about 26 hours on charges of breaking into a vehicle in 2008.

Franco admitted grabbing the handcuffed teen by the neck with both hands and shoving him along a wall. The former chief also said he swung at the juvenile with an open hand.
