The rail company filed suit July 12 saying the developers of the property had improperly taken its land for the project and asked for a restraining order stopping construction.
The (Wilmington) News Journal reported that an agreement worked out under the guidance of U.S. District Judge Gregory M. Sleet will keep railroad tracks on the site intact while allowing theater construction to continue. The agreement will affect plans for a proposed parking garage on the site, but the developers say the garage is not critical to the cinema's opening.
