A town official opened fire, injuring a suspected bank robber in Hatboro, Montgomery County.

HATBORO, Pa. (WPVI) -- A prosecutor says a suburban Philadelphia borough councilman was justified in shooting an unarmed bank robbery suspect he was chasing.

Montgomery County District Attorney Risa Vetri Ferman says 60-year-old George Forgeng used "non-deadly force" in shooting 30-year-old Kenneth Way in the shoulder and arm July 8.

Forgeng says he was driving when he saw a dye pack explode as Way ran from TD Bank in Hatboro. Forgeng gave chase.

The DA says the 5-foot-8-inch Forgeng was justified in shooting Way after he turned and advanced toward the councilman in an "aggressive manner." Way is 6-foot-4 and weighs about 260 pounds.

Forgeng told investigators he purposely avoided shooting Way in the torso.

Way is jailed awaiting trial.
