The first lawsuit has been filed after four people were killed by an apparent carbon monoxide leak at a Wilmington apartment complex.

WILMINGTON (WPVI) -- The first lawsuit has been filed after four people were killed by an apparent carbon monoxide leak at a Wilmington apartment complex.

The family of Carl Dunfee is suing the Evergreen Apartments at Riverfront Heights.

Investigators say a faulty boiler pipe caused the deadly leak last month.

The H and I buildings at the complex have been deemed unsafe, and all the remaining residents have been ordered out.

Management tells Action News it is not commenting.
