I. NAME OF SPONSOR(S)
WPVI-TV, ABC, Inc. ("6abc"), 4100 City Line Avenue, Philadelphia, PA 19131 AND Disney Destinations, LLC. (Hereinafter collectively referred to as "Sponsor").
II. ELIGIBILITY
Entrants must be legal residents of Delaware, New Jersey and Pennsylvania, 18 years of age or older at time of entry.
Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for WPVI-TV, ABC, Inc., Disney Destinations LLC, any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the sweepstakes or supplying the prize, and/or their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to enter or play. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses. "Household members" shall mean people who share the same residence at least three months a year.
III. HOW AND WHEN TO ENTER
NO PURCHASE NECESSARY.
To enter, visit 6abc.com/promotions between October 31, 2015 at 7:30pm and November 16, 2015 at 12:00pm and complete the entry form. The winner will be notified at the phone number or email used to submit their entry and will be announced on FYI Philly on November 21, 2015. Entries will not be acknowledged.
Sponsor can provide no technical support and accepts no responsibility for insuring the receipt or successful submission of your entry. Sponsor is not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. If for any reason the sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of the sweepstakes, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the sweepstakes. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any Web-site, or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from participation in or downloading any materials from this sweepstakes In the event of a dispute over an electronic entry, prize will be awarded to the owner of the e-mail account, not the name on the entry form. Except as otherwise contemplated by these Rules, and to the extent entrants may otherwise elect at the time of Entry, information provided by you for these Sweepstakes is subject to Sponsor's privacy policy located at https://disneyprivacycenter.com/privacy-policy-translations/english ("Privacy Policy").
IV. HOW AND WHEN WINNERS WILL BE SELECTED AND NOTIFIED
POTENTIAL WINNER SELECTION: One grand prize winner will be selected at random on November 16, 2015 from all valid entries received on the entry form.
POTENTIAL WINNER NOTIFICATION: Potential winners will be notified on Monday November 16, 2015 and at the phone number or email address they used to submit their entry.
Limit one prize per winner for this sweepstakes. Odds of winning depend on number of valid entries received.
Final determination of winner is always conditional on verification of eligibility and compliance with all rules and procedures. If the actual value of the prize is less than stated ARV, the difference will not be awarded.
V. PRIZES
One (1) winner will receive one (1) Adventures by Disney travel package to San Francisco and Napa (Hereinafter collectively referred to as the 'ABD Package' or 'trip') for the winner and one (1) guest. The ABD Package is subject to the restrictions set forth below.
The ABD Package includes: Two (2) round trip coach air fares from the Philadelphia International Airport airport (as selected by Disney to be the "airport of origin" to a San Francisco area airport (as selected by Disney). Accommodations for this tour consist of one (1) standard/double occupancy room for four (4) nights at The Fairmont San Francisco Hotel. Participation in a guided group travel experience; services of two (2) Adventure Guides for group travel experience; transportation within the Trip; services of local experts; on tour luggage handling; gratuities for bellman, housekeepers, drivers activities expressly included in the Trip and travel taxes associated with Trip. The group travel experience is not a private tour and may be attended by up to thirty-five (35) other travelers. Certain other restrictions shall apply to the ABD Package, which restrictions shall be determined by Disney in its sole and absolute discretion. Each winner and his/her guest must travel together on the same Trip and from the same Airport of Origin. All travelers must be at least four (4) years old at the time of travel. The Trip components are subject to change without notice.
The ABD Package shall not include the following: transportation to and from the airport of origin, unspecified meals, alcoholic beverages, unspecified taxes, gratuities of the two Adventure Guides, travel insurance, laundry service, merchandise, parking, room service, activities not expressly included in the trip, souvenirs, telephone calls, mobile phone roaming fees, WiFi, internet services, incidental expenses and baggage fees, custom and immigration fees, passport costs, or all other charges and expenses not explicitly included in the package pursuant to this agreement. The ABD Package (and all elements thereof) may not be sold, redeemed for cash, traded, transferred or rescheduled except in Disney's sole and absolute discrestion. The ABD Packages may not be sold or transferred to any other person or third party.
The ABD Package must be booked by May 5, 2016 and travel must be completed by October 16, 2016. ABD Package fulfillment is subject to certain restrictions and is subject to availability. Advanced reservations required. Winner must be at least eighteen (18) years of age to enter and win. Travelers under the age of eighteen (18) must be accompanied by a parent/legal guardian in the same room who must be eighteen (18) years of age. The ABD Package may not be sold, redeemed for cash, traded, transferred or rescheduled to dates other than as set above. Prize components may not be separated. Certain travel restrictions apply.
The approximate retail value of this prize is Six Thousand One Hundred Thirty Eight Dollars ($6,138.00). Actual retail value depends on the date of travel. Final actual value at time of booking and travel may be substantially more or less depending on dates of travel, point of origin and ticket availability. Some restrictions apply.
Federal, state and local taxes, if any, are the sole responsibility of the winner, who will receive an IRS Form 1099 reflecting the final actual value of any prize valued at $600 or more. For prizes valued over $600, winner must submit a validly executed IRS form W-9.
VI. RELEASES
By participating, entrants agree to be bound by these official rules and the decisions of the Sponsor/Judges and the sweepstakes administrator, which shall be final in all respects.
By participating in this sweepstakes and accepting any prize that they may win, entrants agree to release WPVI-TV, ABC, Inc., Disney Destinations, LLC, their parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this sweepstakes and/or acceptance or use of the prize.
Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, worldwide in perpetuity, or on a winner's list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor's sole discretion, without further obligation or compensation.
To claim prize, (a) winner must provide proof of age, identity and residency, (b) winner must sign and return affidavit of eligibility/compliance with rules, publicity/liability release and indemnification, and (c) winner's intended guest(s) or travel companion(s), if any, must sign liability/publicity release, all within the time period specified by Sponsor.
At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: (1) potential winner's failure to respond to notification within seven (7) business days after its transmission; (2) the return of an email notification as undeliverable after three (3) attempts; (3) potential winner's failure to provide Sponsor with satisfactory proof of age, identity and residency; (4) potential winner's failure to execute and return an Affidavit of Eligibility/Liability/Publicity Release within seven (7) business days after it is mailed; (5) potential winner's failure to validly claim any prize within ten (10) days after it is sent; (6) potential winner's failure to validly book the prize by May 5, 2016 and complete travel by October 16, 016 and (7) any other non-compliance with Rules. In the event of a prize forfeiture, the Sponsor may, in its sole discretion, award or not award the forfeited prize to an alternate winner.
VII. MISCELLANEOUS; WINNERS' LIST
Void where prohibited. All federal, state and local laws and regulations apply.
Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify and/or suspend the contest in the event of tampering or other circumstances, including but not limited to acts of God or civil disturbance that render it impractical or impossible to complete or fulfill the contest as originally planned.
