PHILADELPHIA (WPVI) --Charges are expected soon against former Eagles player and current Buffalo Bills running back LeSean McCoy and three others after an after hours assault on several off-duty police officers inside a bar in Philadelphia's Old City.
But investigators say charges are not expected to be filed Wednesday night, saying they are in no rush since they want to make sure they have a rock solid case.
Fortunato Perri Junior represents one of the officers. He says what happened next to his client and one of the other officers amounts to aggravated assault.
Perri says, "They suffered serious facial fractures and multiple bones in their faces. The video we've seen clearly indicates that they were being stomped and beaten and struck while they were on the ground. So for anybody to characterize this as a bar fight - this was aggravated assault that occurred in a bar - plain and simple."
Perri said his client and the other injured officers may have suffered permanent injuries. He called them victims of a serious crime, and is looking forward to telling their side of the story.
"It's quite scary that these men were trying to enjoy a night out in our town - a town that they protect and they serve - and then they become crime victims for being in that bar that night," Perri said.
Philadelphia police are combing through cell phone videos of the incident inside the Recess Lounge in Old City on Sunday morning.
Action News obtained viewer video from the incident at 2:45 a.m. Sunday at the Recess Lounge in Old City.
In addition, TMZ has posted footage of the bar fight that apparently shows the NFL star's face.
McCoy and three others allegedly assaulted the off-duty police officers during an argument over champagne.
A source tells Action News the police officers had ordered multiple bottles of champagne and, according to witness accounts, one of the men with McCoy grabbed a bottle out of one of the cop's hands.
That led to an argument, police said, and one of the police officers was punched and knocked to the ground.
While on the ground, Philadelphia police say that officer was punched, kicked and stomped on his body and head multiple times by all four suspects.
The second officer, along with security guards, went to break it up, and everyone involved was then ejected from the club.
The first officer drove himself to the hospital, where he was found to be suffering from broken ribs, a broken nose, a laceration to his right eye and a sprained thumb, police said.
The second officer was also admitted to the hospital, where he received stitches over his right eye and is being treated for a possible skull fracture.
Sources also tell Action News that the officers involved will not face charges.
Police say outside surveillance video showed the ejection from the club, but surveillance cameras inside the club were not working.
"Nothing should amount to this kind of incident where you have someone going to the ground and have any individual stomping a person over a bottle of champagne. It makes no sense whatsoever," said Lt. John Stanford of Philadelphia Police.
Action News has learned that one member of the group is a former NFL player, another is a former college football player with the University of Pittsburgh, where McCoy also played.
McCoy's agent, Drew Rosenhaus, declined to comment when contacted by Action News.
The Buffalo Bills put out a statement Monday that reads:
"We are aware of the reports regarding LeSean McCoy and are in the process of gathering more information. We will not provide any further comment at this time."
A police sergeant was with the officers at the time, sources tell Action News, but was not involved in the incident.
