The family of a man killed by Wilmington police is suing, saying the shooting was not justified.

WILMINGTON (WPVI) -- The family of a man killed by Wilmington police is suing, saying the shooting was not justified.

Cell phone video captured the scene in September 2015 as officers turned their guns on 28-year-old Jeremy McDole, seen in a wheelchair.

Authorities say McDole had a .38 caliber gun, but his family claims he was unarmed.

The lawsuit alleges the officers were poorly trained and could have used less-than-deadly force.

The results of an official investigation have not been released.
