Suspect in death of Amy Joyner-Francis in court

WILMINGTON, Del. (WPVI) -- One of the three teens charged in the death of a Howard High School student was in a Wilmington, Delaware court on Tuesday morning.

The 16-year-old girl is charged with criminally negligent homicide in the death of Amy Joyner-Francis.

A judge granted a hearing to determine whether the suspect should be tried as an adult. That hearing is set for July.

Action News is not identifying the teen because she is still charged as a juvenile.

Investigators say Joyner-Francis, 16, was assaulted by three teenage girls back on April 21st in a bathroom inside Howard High School of Technology in Wilmington, Delaware.

The medical examiner determined that Joyner-Francis died from a pre-existing heart condition that was aggravated by the assault.

The family disputes that finding and announced through a spokesperson earlier this month they are seeking a second autopsy.

The other two suspects, also 16, are charged with third-degree criminal conspiracy, which is punishable by up to a year in prison, they added. They will be tried in Family Court.
