Trial begins against father accused of killing drunk driver

ANGLETON, TX -- The trial of a Texas father, accused of shooting his sons' killer, is set to start Monday morning in Angleton.

The circumstances surrounding this case captured a lot of attention back in December 2012. Deputies claim the Barajas family ran out of gas on County Road 144 near Alivn. The father, David Barajas Sr., and his two sons, David Jr. and Caleb, were pushing the car off the road. Their mother and sister were inside the vehicle.

Investigators said Jose Banda, 20, was driving drunk and slammed into them. The impact killed the 11 and 12-year-old boys.

As paramedics rushed to the scene, deputies explain Barajas Sr. walked to his nearby home, grabbed a gun, and shot Banda in the head. The bullet killed him.

Two months after the crash, the Sheriff's Office arrested Barajas for the killing. His trial is set to start this morning in Angleton. Eyewitness News will be monitoring the courtroom for any developments.
