Man beaten with bat inside Lehigh Valley store

ALLENTOWN, Pa. (AP) - July 28, 2008 Pa. police: Wal-Mart shopper grabs bat, beats foe

Police say a Wal-Mart shopper ran into a foe inside the store in Allentown and beat him with an aluminum bat that he grabbed from a shelf.

Police say 49-year-old Jose Millan had an ongoing feud with the victim, 62-year-old Jose Baez-Barreto. Police say Millan spotted the older man at a McDonald's inside the Allentown store Sunday and started swinging at him.

A police affidavit says Millan screamed "I'm going to kill you!" as he struck Baez-Barreto several times.

The victim's brother and a store employee intervened, and Millan dropped the bat and fled. He was arrested in the parking lot and later charged with aggravated assault and other offenses.

Millan is being held on $35,000 bail. It is not clear if he has a lawyer.

Baez-Barreto was treated and released from a hospital.
