A judge has told people along the North Jersey shore not to worry that the state is trying to take over their business.

The State Department of Environmental Protection is using eminent domain condemnation proceedings to acquire land for a protective sand dune project along most of the state's 127-mile coast.

Private beach operators filed a lawsuit over fears that the state would take it a step further and seize their business as a part of the storm protection project.

A state judge rejected claims by people on Risden Beach and Bay Head's, saying the state has made no moves to take over the beaches.
