Attorney: Fired Ala. officers followed training

BIRMINGHAM, Ala. - May 21, 2009 - Attorney Gayle Gear said Thursday the Birmingham officers did not know the suspect, Anthony Warren, had been ejected from his car and was unconscious at the end of a police chase.

The officers have been fired but Gear says they're appealing.

Attorney Wendy Crew says she expects to file a lawsuit on Warren's behalf this week. Crew says the suit will seek monetary damages and changes in the way the city trains police officers.

The incident happened more than a year ago but the tape only surfaced recently when a prosecutor preparing for Warren's trial asked for the original. Her copy did not include the beating.
