Judge rules parents can sue NJ college

TRENTON, N.J. - November 11, 2011

Susan and John Fiocco Sr. claim lax security allowed a stranger to enter a dormitory and murder their son, John, in 2006. His blood was found around a trash compactor and his body was found in a landfill a month later.

The judge ruled the college is not shielded from liability because a jury could conclude the school was negligent or allowed a dangerous situation to exist.

The parents' lawyer, Christine O'Hearn, told The Times of Trenton the family looks forward to a fair resolution of the case.

College spokeswoman Stacy Schuster told the newspaper we may never learn the circumstances of Fiocco's death.
