Prosecutors say 85-year-old Edward Bullock had sex with a 10-year-old boy, in juvenile detention, back in 1988.
Bullock was Warren County sheriff at the time.
Bullock has faced similar accusations before.
He resigned in 1991 when an undercover officer caught him trying to solicit underage sex.
Bullock is now free on bail.
