Attorneys ask to move Del. officer slaying trial

GEORGETOWN, Del. - March 19, 2010

In a motion released Thursday, public defenders say because of pre-trial publicity and the overwhelming sentiment against Derrick Powell's innocence, his October trial in the slaying of Patrolman Chad Spicer should be moved to Kent County or New Castle County. Judge T. Henley Graves and attorneys met Thursday to discuss the case.

The motion cites a University of Delaware Center for Applied Demography and Survey Research poll that found more than 94 percent of Sussex residents polled are familiar with the case.

Powell of Cumberland, Md., is charged with first-degree murder in Spicer's death and second-degree assault in firing the shot that also injured Cpl. Shawn Brittingham.
