Daycare worker found not guilty in toddler's death

DOYLESTOWN, Pa. - March 22, 2010

That verdict was handed down Monday in the case of /*Rimma Shvartsman.*/

The former owner of Fairy Tales Daycare in Penndel, Bucks County was accused of leaving two-year-old /*Daniel Slutsky*/ inside a locked van on a scorching hot day in July, 2009.

Investigators said Shvartsman picked up Slutsky at his home and drove him to the daycare. But, prosecutors said, she forgot about the child and left him in the van for hours.

When he was found, investigators said, Slutsky's body had a temperature of 108 degrees. He also appeared to have let himself out of a car seat in an attempt to escape the van.

Shvartsman was charged with involuntary manslaughter and endangering the welfare of a child. Shvartsman's lawyers say a health scare contributed to a memory lapse.

After she was found not guilty, Shvartsman left the courtroom in tears.

"This is a tough time for both families," said Shvartsman's attorney Michael Mustokoff. "Nothing has really changed except our relief. The fact of the matter is we're still sorrowful and remorseful for what happened."

Slutsky's parents were not in the courtroom when the verdict was read.

On Thursday, Shvartsman apologized on the witness stand for Slutsky's death. That drove the boy's mother, Lyudmila Slutsky, to lash out at her.

Lyudmila Slutsky rose from her seat, saying Shvartsman wouldn't be putting the family through a trial if she was truly sorry.

Security officers removed Slutsky from the courtroom.

The boy's parents have filed a lawsuit against the daycare center.
