Ousted gay Eagle Scout to testify in Philly trial

PHILADELPHIA - June 21, 2010

The local council is suing the city of Philadelphia to retain its $1-a-year lease on city property. The city wants to rescind the headquarters' lease unless the council adopts its anti-discrimination code.

The Cradle of Liberty Council tried a "don't ask, don't tell" policy to appease both the city and the national Boy Scout policy banning gays. But the city says that doesn't go far enough.

The council says it ousted gay Eagle Scout Greg Lattera in 2003 because he discussed the issue on TV, not because of his sexual orientation.

Closing arguments in the federal trial are expected Tuesday.
