The complaint against Michael A. Brown Sr. says that because he works for a nonprofit that receives government money, he's therefore barred under federal law from seeking a partisan elected office.
The News Journal of Wilmington reports that the U.S. Office of Special Counsel is investigating the complaint. .
Brown says he doesn't think the complaint, filed by a Democratic operative, has "any legs" and that he doesn't receive federal funds for his work with a nonprofit that provides housing, health care and other services to the homeless. But he says he'd likely resign his job if the office did find a violation.
Brown is the only Republican councilman.
