GARDEN CITY, N.Y. (AP) - February 19, 2009 A notice of claim - the first step toward suing a municipality -
was filed Tuesday in state Supreme Court. It claims the county and
police were negligent, careless and reckless in their actions
before the Nov. 28 stampede in Valley Stream that killed Jdimytai
"Jimmy" Damour (jim-mee-TREE' Di-MOHR').
Nassau County Attorney Lorna Goodman says there is no merit to
the claims.
Damour's family has said it intends to refile a lawsuit against
/*Wal-Mart*/ and others, which was dropped after the relatives changed
lawyers. Wal-Mart Stores Inc. has said it will work with officials
to develop stronger safety measures.
