Judge hears arguments in dredging dispute

WILMINGTON, Del. - December 8, 2009

The judge heard more than three hours of arguments Tuesday but said she would accept additional briefs over the next two weeks before ruling.

After the state denied a permit this summer, the Corps said it could dredge the river without state permits in order to maintain navigation.

The state says dredging without state permits would violate state and federal law, and that deepening the channel is different than the maintenance dredging the Corps says it can do without permits.

The Corps says the state has no evidence to back up its claim that potentially harmful sediments would be stirred up by the planned dredging.
