Forty-seven-year-old Gerard Shaffer and his son, also named Gerard, are charged in the fatal beating of 45-year-old Mark Wallace last month.
Police say the Shaffers were in a car when Wallace walked in front of them at an intersection, prompting an argument over who had the right of way. They say the April 8 confrontation turned physical and the Shaffers pummeled Wallace.
The Shaffers were in court Wednesday for a preliminary hearing. Defense attorneys for the men say they believe the victim was intoxicated and was the aggressor.
The elder Shaffer was suspended 30 days with intent to dismiss and allowed to retire.
