Police say troopers using SONAR found the body of 39-year-old Daniel Favretto around 9:15 a.m. in Upper Township, New Jersey.
According to investigators, Favretto was in a boat with his brother, 42-year-old Carlo, retrieving crabs in Gibson Creek.
Daniel Favretto fell overboard as the boat travelled across the water, police say, and the boat struck land.
Carlo was ejected from the boat, but was not injured. Rescuers at the scene Monday say Carlo watched as Daniel went under the water.
Neither man was wearing a life jacket, police said.
